By accessing https://boompow.online, joining our waitlist, placing an order, or using any Boom Pow Vegan Kitchen service, you agree to these Terms of Service. If you do not agree, do not use the site or services.

Boom Pow Vegan Kitchen ("Boom Pow," "we," "us") is a plant-based ghost kitchen operating in Virginia Beach, VA. We are not a dine-in restaurant. All orders are prepared for pickup or delivery only.

• All prices are in USD and include applicable taxes unless stated otherwise.
• We accept payment via Stripe and major delivery platforms (Uber Eats, DoorDash, Grubhub).
• Orders are confirmed only after successful payment authorization.
• We reserve the right to cancel or refuse any order for reasons including item unavailability, suspected fraud, or operational constraints.
• Promotional codes and discounts must be applied at checkout and cannot be combined unless explicitly stated.

• Delivery: We deliver within the Virginia Beach Oceanfront area. Delivery radius and fees are shown at checkout. Estimated delivery times are not guaranteed and may vary due to traffic, weather, or order volume.
• Pickup: Pickup orders must be collected within 15 minutes of the stated ready time. Uncollected orders may be discarded without refund after that window.
• Third-party delivery: When ordering through Uber Eats, DoorDash, or Grubhub, their delivery terms, fees, and policies also apply.
• Address accuracy: You are responsible for providing a correct delivery address. We are not liable for failed delivery due to incorrect information.

• We stand behind our food. If your order is incorrect, missing items, or of unacceptable quality, contact us within 2 hours of receipt at contact@boompow.online or through the platform you ordered from.
• Refunds are issued at our discretion, typically as original payment reversals or account credit.
• We do not offer refunds for orders that were delivered correctly but did not meet personal taste preferences.
• Perishable food items cannot be returned.

You may not use Boom Pow services to:

• Harass, threaten, or abuse staff, delivery drivers, or other customers.
• Submit false, fraudulent, or misleading orders or payment information.
• Scrape, mine, or automate data collection from our website without written permission.
• Resell, redistribute, or repurpose our food, branding, or content for commercial use without a license.

Violation may result in order cancellation, account suspension, and legal action where warranted.

• All Boom Pow food is 100% plant-based and vegan. We do not use meat, dairy, eggs, or honey.
• Our kitchen handles common allergens including wheat/gluten, soy, tree nuts, and sesame. Cross-contact is possible despite sanitation protocols.
• If you have a severe allergy, contact us before ordering at contact@boompow.online. We will advise whether we can safely accommodate your restriction.
• We are not liable for allergic reactions. Customers with severe allergies order at their own risk.
• Ingredient lists and allergen information on the site are current to the best of our knowledge but may change without immediate update.

All content on this site — including logos, menu names, food photography, graphics, and text — is the property of Boom Pow Vegan Kitchen or licensed to us. You may not copy, reproduce, distribute, or create derivative works without written permission.

"Boom Pow," "Boom Pow Classic," "Buffalo Bomb," "Sweet Heat Crunch," and related menu names and branding are trademarks or trade names of Boom Pow Vegan Kitchen.

To the maximum extent permitted by Virginia and U.S. law, Boom Pow Vegan Kitchen is not liable for:

• Indirect, incidental, special, or consequential damages arising from order delays, cancellations, or food quality disputes.
• Damages exceeding the total amount you paid for the specific order in question.
• Issues caused by third-party delivery platforms, payment processors, or service outages beyond our control.

We do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

These terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute arising from these terms or your use of Boom Pow services will be resolved in the state or federal courts located in Virginia Beach, Virginia.

We may update these terms as our business, legal environment, or services change. The updated terms will be posted here with a revised date. Continued use after changes constitutes acceptance.
